PRIVACY POLICY

This Policy is incorporated into and governed by our Terms of Service.

- August 11, 2026 (v3.0): Corrected the disclosure regarding advertising cookies and pixels, which qualify as a "sale" or "share" of personal information under several state privacy laws. SECTION 1 — WHO WE ARE AND WHAT THIS COVERS
Prime 151 Collectibles ("we," "us," "our") respects your privacy. This Policy explains what personal information we collect, why we collect it, who we share it with, and the choices and rights you have.
This Policy covers all of the following, referred to collectively as the Services:
- prime151.com and connected applications
- Our retail location at 358 Broadway Mall, Suite 460, Booth 11, Hicksville, NY 11801
- Our marketplace storefronts: eBay, TCGplayer, CardTrader, Mana Pool, TikTok Shop, and Temu
- Our social storefronts: Facebook, Instagram, and YouTube Shopping
- Live selling broadcasts on platforms including Whatnot, eBay Live, and TikTok Live
- Pop up retail, convention booths, and community events
- Our email, SMS, and customer support systems
- Our wholesale and business to business ordering
A note about third party platforms. When you buy from us on eBay, TCGplayer, CardTrader, Mana Pool, TikTok Shop, Temu, or another marketplace, or watch a live broadcast, that platform collects your information under its own privacy policy, which we do not control. We receive only what the platform passes to us, which is generally your name, delivery address, and order details. Please review the privacy policy of any platform you use.
Platforms based outside the United States. Some marketplaces we sell on are operated from outside the United States and process your information under their own terms and their own local law. Where such a platform passes us an order, we handle that information under this Policy.
SECTION 2 — CHANGES TO THIS POLICY
We may update this Policy to reflect changes in our practices, technology, or the law. The Effective Date above changes when we do, and material changes are noted in the Revision History. Where required by law, we will provide additional notice.
SECTION 3 — NOTICE AT COLLECTION
This table summarizes the categories of personal information we collect, why, and who we disclose it to. Details follow in Sections 4 through 9.

We do not knowingly collect Social Security numbers, driver's license numbers, precise geolocation, biometric identifiers, health information, or information about race, religion, sexual orientation, union membership, or immigration status. Please do not send us any of that.
On identification at trade ins. Where we ask to see government issued photo identification for a trade in, we inspect it to confirm identity and record only your name and that identification was verified. We do not record or store the identification number unless a law or a lawful request requires it. See the Store Credit and Trade-In Terms.
SECTION 4 — HOW WE COLLECT INFORMATION
- Directly from you, at checkout, account creation, wishlist, waitlist, contact forms, claim submissions, event and tournament sign ups, in store purchases, and wholesale applications
- Automatically, through cookies, pixels, SDKs, and server logs when you use the site
- From platforms and partners, including marketplaces that pass us order data, payment processors, installment providers, shipping carriers, and our ecommerce, email, and analytics providers
- In person, at our retail location, pop ups, conventions, and events, including through photography and video
- During live broadcasts, including chat, comments, claims, and recordings
SECTION 5 — HOW WE USE INFORMATION
We use personal information to:
- Accept, process, fulfill, and deliver orders, including pre-orders and local pickup
- Provide customer service, handle claims, and administer returns and disputes
- Verify identity, screen for fraud, and enforce purchase limits and our Terms
- Process payments and support installment financing
- Send transactional messages such as confirmations, shipping notices, and pickup readiness alerts
- Send marketing email and SMS where you opted in, and measure how it performs
- Operate, secure, debug, and improve the Services
- Run events, tournaments, giveaways, waitlists, and loyalty programs
- Produce marketing content, including photography and video from events and broadcasts
- Comply with tax, accounting, insurance, marketplace, and legal obligations
- Establish, exercise, or defend legal claims
We do not use automated decision making that produces legal or similarly significant effects about you. Fraud screening flags orders for human review.
SECTION 6 — ADVERTISING, COOKIES AND YOUR OPT-OUT RIGHT
Please read this Section. It corrects a statement in our prior policy.
6.1 We use cookies, pixels, and similar technologies from advertising and analytics providers, including Google (Analytics and Ads), Meta (Facebook and Instagram), TikTok, and our ecommerce platform.
6.2 We do not sell your personal information for money. However, when advertising cookies and pixels operate on our site, information about your activity is shared with those advertising partners so that they can measure and target advertising. Under the California Consumer Privacy Act and similar laws in other states, that sharing is treated as a "sale" or "share" of personal information, and you have the right to opt out of it.
6.3 How to opt out. Use our Your Privacy Choices page, which is also linked in our site footer. You may also:
- Set your browser or an extension to send a Global Privacy Control (GPC) signal. We recognize and honor GPC as a valid opt out request for the browser that sends it.
- Manage or block cookies through your browser settings
- Use industry opt out tools at optout.aboutads.info and optout.networkadvertising.org
- Adjust ad settings inside your Google, Meta, and TikTok accounts
6.4 Opting out of targeted advertising does not stop you seeing ads. It stops the ads being targeted using information about your activity on our site.
6.5 We do not have a separate response to browser "Do Not Track" signals beyond our recognition of GPC described above.
6.6 We do not sell or share the personal information of anyone we know to be under 16 years of age.
SECTION 7 — SMS AND EMAIL COMMUNICATIONS
7.1 SMS is opt in only. By providing your mobile number and opting in, you consent to receive text messages from Prime 151 Collectibles at that number, which may be sent using an automatic telephone dialing system.
7.2 Consent to marketing messages is not a condition of any purchase.
7.3 Message types may include order and shipping updates, pickup readiness alerts, restock and waitlist alerts, event announcements, and promotions.
7.4 Message frequency varies. Message and data rates may apply.
7.5 Reply STOP at any time to opt out. Reply HELP for assistance, or email support@prime151.com.
7.6 Carriers are not liable for delayed or undelivered messages.
7.7 We do not sell, rent, or license SMS opt in data or mobile numbers to anyone, and we do not share them with third parties for their own marketing.
7.8 Email. Marketing email is opt in and every message includes an unsubscribe link. Transactional messages about an order you placed are not marketing and continue regardless of marketing preferences.
SECTION 8 — WHO WE SHARE INFORMATION WITH
We share personal information only as described here. We do not sell your information for money.
- Service providers who work on our behalf under contract: our ecommerce platform, payment processors, installment providers, shipping carriers, shipping insurers, email and SMS platforms, analytics, customer support tools, and accounting systems
- Marketplaces and social platforms where you place an order, to fulfill it and meet their compliance requirements
- Advertising partners, as described in Section 6, subject to your opt out
- Consignors and manufacturers, limited to what is necessary to fulfill an order, administer a warranty, or handle a recall
- Professional advisors, including our accountant, insurers, and attorneys
- Law enforcement, regulators, or courts, where required by law, subpoena, or valid legal process, or where necessary to investigate fraud, protect our rights, or protect the safety of any person
- A successor entity, in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy
SECTION 9 — PHOTOGRAPHY, VIDEO AND LIVE BROADCASTS
9.1 We photograph and record at our retail location, at events and conventions, and during live selling broadcasts.
9.2 By attending an event, entering our retail location during an announced recording, or participating in a live broadcast including its chat, you consent to our use of that footage, imagery, and chat content for business and marketing purposes across our channels.
9.3 To request removal of an image or clip in which you appear, email support@prime151.com with a description and, where possible, a link or timestamp. We will honor reasonable requests on content we control. We cannot remove content already redistributed by third parties.
9.4 Photography and recording of minors at events requires the consent of a parent or guardian, collected at sign in. See Section 12.
SECTION 10 — DATA RETENTION
We keep personal information only as long as needed for the purpose it was collected, then delete or de identify it. Typical periods:

Records subject to a legal hold are retained until the matter is resolved.
SECTION 11 — DATA SECURITY
11.1 We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encryption in transit, access controls, multi factor authentication on administrative systems, and vendor due diligence.
11.2 Payment card data is handled by PCI DSS compliant processors. We never receive or store full payment card numbers.
11.3 No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you provide information at your own risk.
11.4 Security incidents. If a breach affecting your personal information occurs, we will notify you and the appropriate authorities as required by New York law and any other applicable state or federal law, without unreasonable delay.
11.5 Protect your account: use a unique password, do not share credentials, and notify us immediately at support@prime151.com of any suspected unauthorized use.
SECTION 12 — CHILDREN'S PRIVACY
12.1 The Services are intended for users 18 years of age or older. See Section 2 of the Terms of Service.
12.2 We do not knowingly collect personal information from children under 13. If we learn we have, we delete it promptly.
12.3 Minors may attend events and shop in store accompanied by a parent or guardian. Where an event sign up collects a minor's information, we collect it from the parent or guardian, limit it to what the event requires, and delete it after the event unless a longer period is required.
12.4 A parent or guardian may request access to or deletion of a minor's information at support@prime151.com.
SECTION 13 — YOUR PRIVACY RIGHTS
13.1 Rights available to everyone. Regardless of where you live, you may ask us to:
- Provide access to the personal information we hold about you
- Correct information that is inaccurate
- Delete information that is no longer needed
- Opt out of marketing email and SMS
- Opt out of targeted advertising and the sharing described in Section 6
13.2 Additional state rights. If you are a resident of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Tennessee, Indiana, Kentucky, Rhode Island, or another state with a comprehensive privacy law, you may also have the right to:
- Know the categories of personal information collected, the sources, the purposes, and the categories of third parties it is disclosed to, which are set out in Section 3
- Obtain a portable copy of information you provided to us
- Opt out of profiling with legal or similarly significant effects. We do not conduct such profiling.
- Limit the use of sensitive personal information. We do not collect sensitive personal information as those laws define it.
- Be free from discrimination or retaliation for exercising your rights. We will not deny you service, charge you a different price, or provide a lesser experience because you exercised a privacy right.
13.3 How to exercise your rights. Email support@prime151.com with the subject line "Privacy Request," or use the Your Privacy Choices page for advertising opt outs.
13.4 Verification. To protect your information, we verify requests, usually by confirming control of the email address on the account and matching order details. We may need more information for a request involving a large amount of data. We do not use verification information for any other purpose.
13.5 Authorized agents. An authorized agent may submit a request on your behalf with written proof of authorization. We may still contact you to confirm.
13.6 Timing. We respond within 45 days, and may extend once by an additional 45 days with notice to you.
13.7 Appeals. If we decline your request, you may appeal by replying to our decision with the subject line "Privacy Appeal." We will respond in writing within 45 days with our decision and the reasons for it. If we deny the appeal, you may contact your state Attorney General.
13.8 Limits. We may decline a request where an exception applies, for example where we must retain records for tax, accounting, insurance, fraud prevention, or legal defense purposes. A deletion request does not erase your order history where we are legally required to keep it.
SECTION 14 — WHOLESALE AND BUSINESS ACCOUNTS
Information collected from wholesale applicants and partners, including business name, resale or exemption certificate, tax identification number, authorized contacts, and order history, is used to verify eligibility, apply tax exemption, invoice, and maintain records required by tax authorities. We treat wholesale partner tax documentation as confidential and do not disclose it except to tax authorities, our accountant, or as required by law. See the Wholesale Partner Agreement.
SECTION 15 — INTERNATIONAL USERS
The Services are operated in the United States and information is processed and stored there. If you access the Services or purchase from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those of your country, and you consent to that transfer. Where we ship internationally, we share the information necessary for customs and delivery.
SECTION 16 — THIRD-PARTY LINKS
The Services link to third party sites and platforms we do not control. This Policy does not apply to them. Review their privacy policies before providing information.

SECTION 18 — ACKNOWLEDGMENT
By using the Services, you acknowledge that you have had the opportunity to read this Privacy Policy and the Terms of Service. If you do not agree with this Policy, please stop using the Services.
We collect what we need to get your order to you, and nothing we would not want collected about ourselves.
